PURCHASE and SALE AGREEMENT

Definitions used herein include:

"BUYER" shall herein be defined as:

"PUPPY" shall herein be defined as:

A Boykin Spaniel puppy, sex   MALE whelped ___/___/2007_ (registerable) with the American Kennel Club (AKC)Foundation Stock Services (FSS),with the registered name of:

Sire: Boulder Brook's Blazing Lee  BSR09971  FSSSN839326/01

Dam:Boulder Brook's Justa Rose  BSR 014192  FSSSN839331/01

And the Boykin Spaniel Society (BSS) for an additional service fee.

1.      The Boykin Spaniel puppy described above is sold for the sum of $______payment made by deposit $______________and final payment of $_____________________.

 

2.      The PUPPY is defined here to be a Boykin Spaniel puppy which is in good health at the time of sale, and embodies the characteristics of the Boykin Spaniel breed. This PUPPY is purebred and is registerable (registered) with the Boykin Spaniel Society.

 

3.      This PUPPY is sold as a Hunter Dog which will have a limited registration, which will prohibit breeding and registering offspring. (If registered with the BSS, the BUYER agrees this PUPPY is to be neutered by age of one year old, and veterinarian confirmation of this procedure must be supplied to the BREEDER. Upon proof of neutering, the breeder will provide the registration papers for the puppy.)

 

4.      The BREEDER guarantees the above described dog to be healthy at the time of sale. Although the kennel has  treated the puppy for intestinal parasites, it is not unusual to still have them. The puppy is not guaranteed against them. 

 

5.      The BREEDER does not assume any liability for any injury to said puppy after delivery.

6.      The BUYER agrees to have this puppy examined by a veterinarian within 72 hours of delivery. If the puppy is found to be other than healthy by the BUYER'S veterinarian, it shall be returned to the BREEDER immediately, with a vet's note describing the problem, and an exchange puppy will be provided. If an exchange puppy is not available, the  purchase price will be refunded. Deadline for this exchange or refund is ten (10) days after purchase.

7.      All appropriate shots for the PUPPY'S age have been given, and a record of this vaccination history is supplied.

8.      The BUYER agrees to maintain the puppy's health in good condition, and to provide yearly examinations, vaccinations, heartworm test, and any other usual procedures necessary to assure good health. The puppy should receive additional vaccinations until at least 16 weeks old, or longer as the BUYER’S veterinarian recommends. 

9.      The BREEDER has done everything possible to produce healthy sound puppies by raising the puppies in the best way possible in regards to diet, exercise, socialization and veterinary care.

10.There are many factors that can influence growth and development, such as diet, exercise, weight gain, etc. The BUYER assumes the responsibility to carry on with the appropriate vaccinations, exercise and feeding schedule. The BUYER agrees to keep the puppy slim throughout it's normal growth period to help reduce likelihood of hip dysplasia (CHD). The BREEDER can offer no further guarantees on CHD once the care of the puppy is no longer under his control.

11.The BUYER agrees that neither he/she nor the BUYER'S estate/executors may sell this PUPPY or transfer ownership of this PUPPY without the BREEDER'S knowledge and written consent

12.The BUYER hereby agrees that if at any time the Buyer cannot take proper care of the puppy, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) take the PUPPY back or (b) assist the BUYER in finding a suitable home for the PUPPY or (c) place the puppy with Boykin Spaniel Rescue group.

13.The BUYER agrees to notify the BREEDER of any changes of address during the PUPPY'S lifetime.

14.The BUYER agrees to provide a suitable fenced area or restraints for this puppy, to keep it in the yard area, and out of the roads.

15.A  dog to be replaced  must be returned to Boulder Brook Kennel (at the owners expense) with the original registration certificate transferring ownership to the kennel owner. There are no exceptions to this rule. The breeder will select a replacement puppy  of equal or better quality. The costs of health certificate and shipping the replacement dog will be the responsibility of the owner.

16.The BUYER agrees the state of Virginia will have jurisdiction in any disputes concerning this agreement and purchase, and venue will be in Fauquier County.

The BREEDER neither makes or implies any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer with respect to this sale. The Buyer's signature below indicates that he/she has read, agrees and does understand all the conditions of the Sales Agreement and Contract of Sale.

FEEDING AND RAISING DIRECTIONS

·             Feed ¼ cup (a handful) 3 or 4 times a day with water

·             Feeding the pup by hand makes it friendly around the food – kids around the food bowl are viewed as good

·             Feeding the pup by hand helps establish you as top dog and leader of the pack

·             Pot bellies are bad for hips – cut back on the amount

·             It takes 4-5 hours to process food. Feeding after 8 PM means you will be up at 2-3 AM and makes house breaking more difficult.Until the puppy is about 6 months old, it will not have full control of its body functions

·             Boykins are usually soft dogs meaning a harsh word or loud shout“NO” will be understood. More than that may make the dog afraid.

·             Punishing the puppy for accidents after the act is a waste of time as the pup does not relate the punishment and the act. A loud“NO” if it is caught in the act is sufficient or shake a can containing coins

·             Hip dysplasia is partially hereditary and partially environment. Make the environment friendly for 2 years.No pot bellies.No stair climbing when pup is small.No long walks. No running with bicycles.Chasing balls is OK – be sensible – just don’t push the puppy’s capabilities.

·             USE large dog (slower growth) puppy food until it reaches 2 years old. Usually has 10-12% fat and 26-28% protein.

·             Feed 1CC (1/4 teaspoon) liquid vitamen C per 20 pounds until 2 years old to reduce hip dysplasia likelihood
